Welcome to Do-Ya, an all-in-one concierge healthcare platform provided by Do-Ya Medical Services, LLC (“Do-Ya,” “we,” “our,” or “us”). By accessing or using our website, mobile app, or related services (collectively, the “Platform”), you agree to these Terms of Use (“Terms”). If you do not agree, please discontinue use of the Platform immediately.
1. Acceptance of Terms
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Platform Overview
Do-Ya provides a platform connecting patients or clients (“Users”) with independent healthcare and wellness professionals (“Providers”). The Platform facilitates scheduling, communication, and payment but does not directly provide healthcare or wellness services. Providers listed on the Platform are independent contractors, not employees or agents of Do-Ya.
3. Eligibility
To use the Platform, you must:
• Be at least 18 years old.
• Have the legal capacity to enter into this agreement.
• Provide accurate and complete information during registration.
4. Account Registration
• Users: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.
• Providers: Providers must complete an onboarding process, including background checks and verification of credentials. Failure to provide accurate information or meet eligibility requirements may result in denial or termination of access to the Platform.
5. Fees and Payments
• For Users: You agree to pay for all services booked through the Platform. Payment processing is facilitated by third-party payment processors (e.g., Stripe). Do-Ya does not directly handle payments.
• For Providers: Providers set their rates and agree to pay applicable fees, including commissions and onboarding fees. Payments are processed according to the schedule outlined in the Provider Agreement.
6. Service Listings and Bookings
• Users can browse available services and book appointments based on provider availability.
• Providers are responsible for accurately describing their services and availability.
• Cancellations and refunds are subject to our cancellation policy.
7. Platform Limitations
Do-Ya is not a healthcare provider. We do not verify, monitor, or guarantee the accuracy, quality, or legality of services provided by Providers. Users should exercise discretion and perform their due diligence when selecting Providers.
8. Prohibited Conduct
You agree not to:
1. Violate any applicable laws or regulations.
2. Misuse the Platform for fraudulent purposes.
3. Harass, threaten, or harm other Users or Providers.
4. Interfere with the operation of the Platform, including hacking or introducing harmful software.
9. Intellectual Property
All content on the Platform, including logos, text, graphics, and software, is owned by Do-Ya or licensed to us. You may not copy, modify, or distribute any content without prior written consent.
10. Privacy
Your use of the Platform is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.
11. Disclaimers
• Do-Ya provides the Platform “as is” without warranties of any kind.
• We are not liable for the actions, omissions, or performance of Providers or Users.
• We do not guarantee uninterrupted access to the Platform.
12. Limitation of Liability
To the maximum extent permitted by law, Do-Ya is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform.
13. Indemnification
You agree to indemnify and hold Do-Ya harmless from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your interactions with other Users or Providers.
14. Termination
We reserve the right to suspend or terminate your account at any time for any reason, including violations of these Terms. Upon termination, you must cease using the Platform.
15. Modifications to the Terms
Do-Ya may update these Terms at any time. Changes will be effective upon posting to the Platform. Continued use of the Platform constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes will be resolved exclusively in the state or federal courts located in Orlando, Florida.
